Please read these Terms and Conditions ("Terms") carefully before using the Fetchr Ride mobile application and services ("Service") operated by Fetchr Ride ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old to use the Service. By using the Service you confirm that you meet this requirement.
Drivers must hold a valid South African driver's licence and, where required by law, a current Professional Driving Permit (PrDP). You warrant that all documentation submitted during onboarding is genuine and current.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account at support@fetchr.online.
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, unsafe, or abusive behaviour.
Fetchr Ride is a technology platform that facilitates the matching of passengers with independent drivers for intercity travel. We are not a transport operator or carrier. Drivers are independent contractors, not employees or agents of Fetchr Ride.
We do not guarantee the availability of drivers on any specific route or at any specific time. The platform is provided "as is" and "as available".
When a passenger places a booking request and a driver accepts it, a direct transport agreement is formed between the passenger and the driver. Fetchr Ride is not a party to that agreement.
Fares are set by drivers and displayed to passengers before confirmation. Fetchr Ride does not collect or process fare payments; settlement of the agreed fare is between the passenger and driver.
Bookings are confirmed via a one-time OTP. Sharing your OTP with anyone other than your driver is prohibited.
Driver accounts require an active monthly subscription to be visible to passengers and to accept trips. Subscriptions are purchased and managed entirely through Google Play Billing.

Passengers must behave respectfully toward drivers. Drivers must comply with all applicable road traffic laws and ensure their vehicle is roadworthy before every trip.
Both passengers and drivers are rated after each trip. Ratings must be honest and based on the actual trip experience. Fake, coerced, or retaliatory ratings are prohibited and may result in account suspension.
Drivers are solely responsible for the safe operation of their vehicles and must comply with all applicable road traffic legislation. Fetchr Ride accepts no liability for accidents, injuries, or property damage arising from a trip.
Passengers are responsible for their behaviour during a trip. Unsafe, threatening, or illegal behaviour may result in immediate account suspension and, where appropriate, referral to law enforcement.
All content, trademarks, logos, and software within the Service are the property of Fetchr Ride or its licensors. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our express written permission.
To the maximum extent permitted by applicable law, Fetchr Ride shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to personal injury, property damage, or financial loss resulting from a trip arranged through the platform.
Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the total subscription fees (if any) paid by you in the three months preceding the claim.
You agree to indemnify and hold harmless Fetchr Ride, its directors, employees, and agents from any claims, losses, damages, or expenses (including legal costs) arising from your use of the Service, your violation of these Terms, or your violation of any applicable law or the rights of a third party.
We may suspend or terminate your access to the Service at any time if you breach these Terms. You may delete your account at any time by contacting us. Upon termination, these Terms continue to apply to any prior use of the Service.
We may update these Terms from time to time. We will notify you of material changes via the app or by email. Continued use of the Service after updated Terms are published constitutes acceptance.
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.
