Terms of Use

These Terms govern the Lift Link application, website and services (the “Platform”), operated by FETCHR TECHNOLOGIES (PTY) LTD, company number 2026/080890/07 (“Lift Link”, “we”, “us” or “our”). By registering, publishing or requesting transport, accepting a quote, booking a seat or otherwise using the Platform, you accept these Terms and our Privacy Policy.

Important: Lift Link is a technology platform. Independent Drivers and Shuttle Operators provide transport and ordinarily receive transport payments directly. Lift Link does not drive, own listed vehicles, or guarantee that a request will be accepted or completed.

1 · Services and definitions

Passenger

A user who searches, posts a trip request, requests group transport or books a shuttle seat.

Provider

A verified independent Driver or Shuttle Operator offering transport.

Lift

A once-off town-to-town or intercity journey published by a Driver with seats available.

Trip Request

A Passenger’s requested source, destination, date, time and passenger count.

Shuttle Service

A scheduled seat service or private-group service offered by an Operator.

Booking

An accepted Trip Request, quote or confirmed shuttle reservation.

Trip Terms

The Provider’s disclosed fare, payment, pickup, waiting-time, cancellation, refund, luggage, conduct and service-specific conditions accepted by the Passenger.

The Platform facilitates matching, quotes, bookings, chat, trip sharing and reviews. Unless expressly stated otherwise, a Booking creates a direct transport relationship between Passenger and Provider. Providers are not our employees, agents or partners. Matching, routes, distance and time estimates are informational; availability, acceptance, arrival, earnings and completion are not guaranteed.

2 · Accounts and verification

You must be at least 18, legally capable of contracting, provide accurate current information, use only your own account and protect credentials and OTPs. Everyone registers as a Passenger and may separately apply for Driver or Operator access.

Email and phone

We may require OTP verification before saving contact details or transacting. A supported social identity provider may verify an email.

Passenger checks

Passenger onboarding is proportionate and does not require a South African identity number. We may verify contact details, profile information and a profile photo, and request further lawful evidence only where reasonably necessary for fraud, safety or legal compliance.

Driver and Operator checks

We may require a driving licence, PrDP where applicable, vehicle licensing/registration, roadworthiness, insurance, operating licence or permit, business, capacity, operating-area and expiry information. A verified Driver’s Passenger profile is verified while Driver verification remains valid. Platform verification is not government certification.

3 · Provider legal obligations

Each Provider must determine and meet every requirement applicable to the transport offered, including the National Land Transport Act 5 of 2009 (as amended), the National Road Traffic Act 93 of 1996, operating-licence or permit and PrDP requirements, vehicle licensing and roadworthiness, passenger capacity, appropriate insurance, tax, and provincial or municipal rules.

No unlawful operation

A Provider must not operate a road-based public transport service without the licence or permit required for the vehicle and service. Platform access does not authorise illegal operation.

Providers must use the disclosed authorised driver and vehicle, never exceed licensed or insured capacity, keep evidence current and stop publishing or accepting services when authority expires or information becomes inaccurate. We may request evidence, restrict publishing, remove listings, suspend verification or report suspected illegality.

4 · Publishing, requests and matching

Routes, dates, times, pickup/drop-off points, seats, fare, vehicle, accessibility and luggage information must be accurate. A Driver must not represent a Passenger request as the Driver’s own Lift.

Recommendations

Results may use saved/current location, operating cities, route similarity, distance, time, seats, verification, package permissions and availability. Successful API results and location may be cached locally.

Responsible acceptance

A Driver must view the request and accept only if route, pickup distance, timing, capacity, legal authority and ability to perform are realistic. We may block acceptance under distance, safety, verification or package rules.

Allocation

Once accepted and attached to a Lift, a request may leave the open market. If the relationship lawfully ends before travel, it may return with Passenger approval, subject to date and status.

5 · Shuttles and private-group transport

Passengers may search scheduled shuttles or request private transport for events, churches, schools, airports, families and other lawful groups. The organiser confirms authority to coordinate the group.

Quotes and booking

A group request invites quotes and is not a Booking. A Booking forms when a quote and Trip Terms are accepted and any disclosed deposit or payment condition is met.

Group details

The organiser must disclose adults/children, stops, luggage or equipment, accessibility and child-seat needs. The Provider must confirm legal capacity and suitable equipment.

Minors

A responsible adult must book and supervise travel involving minors. Providers and organisers remain responsible for child-restraint, scholar-transport, consent and safeguarding law.

Schedules

Boarding windows, missed-departure rules, route changes, baggage rules and minimum-passenger conditions must be disclosed before booking. Material changes require prompt notice.

6 · Trip Terms, fares and payments

Passengers must read and accept Trip Terms before joining, accepting a quote or booking. Mandatory law prevails. A material route, vehicle, date, fare or term change requires notice and, where appropriate, renewed acceptance.

Transparent fare

The Provider must disclose whether pricing is per seat, trip, deposit or group total, what is included, payment timing and permitted extras. Different disclosed fares may reflect pickup, drop-off, luggage or negotiated circumstances.

Direct payment

Transport payment ordinarily goes directly to the Provider’s personal or business account, including through a Provider-supplied card link. Lift Link does not hold or settle those funds and is not responsible for Provider banking delays, taxes, chargebacks or payment accounts.

Payment safety

Verify the recipient, amount and Booking; use only trusted Booking links; never disclose a card PIN or OTP; report suspicious requests.

Deposits and payment cycles

Advance payment may secure a group or shuttle Booking only where disclosed. Weekly or monthly arrangements must state covered services, dates, cancellation consequences and refunds.

7 · Cancellations, changes and refunds

Disclosed cancellation, waiting-time, no-show, rescheduling and refund rules apply subject to mandatory consumer law. No undisclosed fee may be charged.

Provider cancellation

The Provider must notify Passengers promptly and handle refunds due for transport paid directly to it. Lift Link may preserve records and assist but does not guarantee replacement transport.

Passenger cancellation

Cancel through the Platform where available and as early as reasonably possible. Repeated abusive cancellations or no-shows may lead to restrictions.

Consumer rights

Nothing removes a cancellation, refund, quality or redress right that cannot be excluded under the Consumer Protection Act or other law.

8 · Driver and Operator packages

Free packages may have limits. Paid packages enable the current publishing, acceptance, operating-city, shuttle, reporting or other allowances displayed at purchase. A package never guarantees requests, bookings, ranking, passengers, income or business success.

Billing

A third-party payment provider may handle checkout under its own terms. Lift Link does not store full card details. Checkout states whether renewal is automatic.

Expiry

We may send in-app or email reminders. On expiry or failed renewal, the account returns to free limits; records remain accessible but restricted actions may be blocked.

Cancellation and changes

Manage renewal in My Subscription. Cancellation normally applies at the paid period’s end unless law or displayed terms require otherwise. We will give reasonable notice of material price or package changes.

9 · Conduct, safety and content

Passengers

Provide accurate details, be ready, pay the agreed fare, wear restraints, follow lawful safety instructions and behave respectfully.

Providers

Drive lawfully, soberly and attentively; never use the app while driving; use a roadworthy clean vehicle; attend pickups; communicate delays; protect Passenger data; and provide legally required receipts.

Messages, calls and files

Participants may communicate and share photos, audio or files. Content is visible to relevant participants and may be processed for lawful security, moderation and Platform operation. You retain ownership and grant us the limited licence needed for those purposes.

Reviews

Reviews must be honest, relevant and based on genuine experience. They may be public. No manipulation, retaliation or unnecessary personal information is allowed.

Emergency

Lift Link is not an emergency service. In South Africa call 112 from a mobile, 10111 for SAPS or 10177 for ambulance/fire before relying on an in-app SOS. Verification and safety tools reduce risk but cannot guarantee identity or conduct.

10 · Location, maps and offline data

Location supports town detection, matching, pickup distance, navigation and safety. You control device permission. Third-party maps, autocomplete, traffic and navigation may be wrong or unavailable; verify addresses and obey road signs.

Cached data may be stale and does not prove current availability. A transaction completes only after successful server confirmation.

11 · Prohibited conduct

You may not impersonate others; provide false documents, listings or locations; discriminate, harass or threaten; operate unlawfully or unsafely; carry illegal/dangerous goods; manipulate reviews, referrals or payments; exceed capacity; share another person’s private data; scrape Platform data; bypass access/package controls; introduce malware; or use the Platform for fraud, exploitation or another unlawful purpose.

12 · Privacy and service communications

We process account, identity/verification, vehicle, location, booking, device, payment-reference, communications, safety and support information as described in the Privacy Policy and in accordance with POPIA. Only provide another person’s details where authorised and necessary.

We may send transactional email, SMS, push or in-app notices about OTPs, Bookings, messages, safety, verification, package limits, expiry, payments and material Terms changes. These are service communications, not necessarily marketing. Marketing choices are managed separately.

13 · Platform rights and account action

We grant a limited, revocable, non-exclusive, non-transferable licence to use the Platform. Our software, branding, design and databases belong to us or licensors and may not be copied, sold, sublicensed, modified or reverse engineered except where law permits.

We may warn, restrict, remove verification, suspend or terminate access for safety risk, fraud, expired or false documents, unlawful transport, unpaid Platform fees, serious or repeated breach, legal demand or system protection. Where appropriate we will give notice and an opportunity to respond.

You may request closure through settings or support. Closure does not erase outstanding payment, refund, investigation, dispute or lawful retention obligations.

14 · Liability and consumer rights

The Platform is provided with reasonable care but may be interrupted or contain errors. Subject to mandatory law, we do not warrant independent Providers, vehicles, routes, map data, availability, earnings or transport outcomes.

The Provider is responsible for transport, driving, vehicle, passengers, baggage, direct payment, refunds and compliance. Lift Link remains responsible for its own Platform obligations.

To the extent lawful, Lift Link is not liable for indirect or consequential loss, lost profit or opportunity, or loss caused by another user, Provider, third-party service, unlawful conduct, or information a user should reasonably verify.

Non-excludable rights

Nothing waives any statutory warranty, right to fair terms, safe or good-quality service, refund, redress or liability that the Consumer Protection Act 68 of 2008 or another law does not allow parties to exclude.

15 · Complaints, law and changes

Raise transport, fare, cancellation and direct-payment refund issues with the Provider through the Booking, and report safety or serious service issues to Lift Link. For Platform complaints email support@fetchr.tech with account, reference, date and requested outcome.

South African law governs. Parties should first attempt good-faith resolution, without preventing urgent relief or a complaint to a competent regulator, transport authority, consumer body, ombud or court.

We may update features and these Terms for product, legal, security or business changes. We will give reasonable notice of material changes and request renewed acceptance where required. Existing Booking terms are not retrospectively changed unless required by law or agreed.

If a provision is unenforceable it is limited or severed; the remainder continues. These Terms, Privacy Policy, displayed package terms and accepted Trip Terms form the relevant agreements.
